These Terms and Conditions will apply to all sales of products offered through the website www.hispalco.com (hereinafter “products”) and shall, together with their offer, price and description as provided at the website, and their specific terms, if any, as set out herein (specific terms), govern the legal relationship between HISPALCO, S.A. (hereinafter HISPALCO) and the CLIENT, standing as the entire agreement between them.
The Terms and Conditions shall be valid for as long as they are posted at the website and shall refer to the products purchased at the time when those terms were applicable.
In order to complete any purchase through the website it shall be an essential requirement for the CLIENT to be of legal age in accordance with Spanish laws and to accept these Terms and Conditions.
On the one hand, HISPALCO, S.A. (hereinafter HISPALCO), owner of the web www.hispalco.com, a company incorporated in accordance with Spanish laws, with registered office at Calle Barranco Pascual, 45 – Pol. Ind. Campo Aníbal, 46530 Puzol (Valencia, España), Tax Identification Number A-96.069.000, and registered at Mercantile Register of Valencia under volume 3712, book 1024, folio 58, sheet number 14045.1
On the other hand, the CLIENT, who is of legal age and whose particulars are as provided by the CLIENT on the registration and accreditation forms. All the information on those forms has been given directly by the CLIENT, who shall therefore be directly and exclusively liable for the truthfulness of that information.
Subject to acceptance of these Terms and Conditions, HISPALCO agrees to provide the USER with the products purchased through the website www.hispalco.com and the CLIENT agrees to pay the price specified upon making the purchase.
HISPALCO does not allow the products offered through its website to be purchased by minors, or for their subsequent resale. Therefore, the accreditation obtained when the product is bought is personal and non-transferable.
Registration at the website shall first be necessary in order to purchase the products offered by HISPALCO at its website www.hispalco.com.
Anyone wishing to register must be of legal age in accordance with Spanish laws and therefore provide his or her date of birth on the registration form.
The CLIENT shall be solely responsible for the quality of the information provided by the CLIENT on the forms during the registration procedure and accepts that it is his or her duty to provide true, accurate and complete information as to the CLIENT’s identity, as requested on the registration, purchase and accreditation forms, and to update all registration particulars in order that they remain truthful, accurate and complete. The CLIENT may however change and/or update his or her particulars at any time by accessing his or her user profile within the site, but we recommend that you always confirm that the data entered and / or modified are correct, especially your e-mail address and your order delivery address, to avoid future inconveniences.
In order to register, it is essential to be of legal age in accordance with Spanish legislation, being able to be a resident of any country in the world.
Once the CLIENT has entered their data and clicked on the registration button, we will send you a confirmation e-mail in order to authenticate the data you have provided during your registration. The sending and receiving of such e-mail is usually automatic and in any case within 24 hours after sending the registration request. If the CLIENT has not received it in said period of time, it may be due to a punctual failure of the communications or to an error in the e-mail address that you have provided. In both cases, the CLIENT must contact us through the e-mail address firstname.lastname@example.org.
If the CLIENT provides any false, inaccurate or incomplete information, or if HISPALCO has proper reasons for suspecting that the information is false, inaccurate or incomplete, HISPALCO shall be entitled to prevent the CLIENT from accessing or using the website, or any of the services, now or hereafter.
All information on the products offered by HISPALCO, including, but not limited to prices, features, description, contents, etc., are available to the CLIENT at the website of HISPALCO, and will be displayed on screen in each case.
We try that the descriptions and representations of the products that the CLIENT can visualize are as accurate and useful as possible. However, the labeling, packaging, size and colors that the CLIENT displays on their screen may vary from the originals of the product. We inform you in each product of its characteristics. However, the photographs and data included in each product file have a merely informative function, therefore HISPALCO declines any responsibility for the appearance of errors in the above mentioned information.
The product features and prices are displayed on screen in Euros and include VAT and any other applicable tax and, failing a typo, shall be those in force at the time of the order. A breakdown of those taxes shall be included on the invoice.
The prices shown at the website cancel any prices previously posted and in force at the time of posting. HISPALCO agrees on a best efforts basis to keep those prices in place, but we reserve the right to change them without notice, duly advising the client thereof when an order is placed. The changes in prices will not affect the orders already placed.
Remember that personal data should be accurately provided in order to avoid confusions or incidents when providing the service and delivering the products purchased.
The products to be purchased shall be selected and added to the shopping cart by clicking on the icon.
After selecting the desired products, and in order to purchase them, the CLIENT should access « CART », which shall be displayed on screen, together with a summary identifying the selected products, their total price, the applicable taxes and the shipping costs, if any. Then click on « Process order ».
Next, the CLIENT must fill in the corresponding registration form that will appear on the screen, or if applicable his user data if he is already registered, and indicate the delivery address of the product.
If the CLIENT should provide any false, inaccurate or incomplete information, or if HISPALCO should have proper reasons for suspecting that the same is false, inaccurate or incomplete, HISPALCO reserves the right to cancel the CLIENT’s purchase. In that event, HISPALCO shall advise the CLIENT and will proceed to refund the amounts paid, deducting any ensuing transaction costs, through the same way used for payment, within fourteen (14) days of that notice.
The CLIENT shall be solely and exclusively responsible for checking those details. HISPALCO shall not be liable to the CLIENT for any errors or inaccuracy of the order if HISPALCO should have shipped the products listed on the order confirmation.
Upon completing the purchase form, the CLIENT shall accept these Terms and Conditions, and the CLIENT shall then be redirected to an online payment platform where the purchase may be concluded by using any of the accepted payment systems.
When the transaction is confirmed, the CLIENT will receive an e-mail message with information on the order and the relevant invoice. The failure to receive this message could be due to a temporary network communications issue or a typo in the e-mail address provided. In both cases, it would be advisable to contact Hispalco’s Customer Service at email@example.com.
You are also advised to please check the details included in that e-mail, and if you detect any error, that you contact Hispalco’s Customer Service at firstname.lastname@example.org.
HISPALCO takes orders at any time, 24 hours a day, every day of the week.
Aiming to give a maximum security to the payment system, we use the secure payment system of PAYPAL, so that the payment will be made online, in real time, through the payment gateway of the mentioned institute, once it has been verified that the data reported are correct. The confidential data (credit card number, expiration and CVV) are not sent to our server but are transmitted directly and in encrypted form to the PAYPAL server, having HISPALCO no access at all to them.
HISPALCO reserves the right to retain any order for security reasons, and not to allow for the time being access to the products and/or services purchased. Affected CLIENTS will be duly advised. HISPALCO also reserves the right to cancel an order if it considers that the information provided by the CLIENT cannot be verified, or if it considers that the product has been purchased by the CLIENT for resale.
HISPALCO shall not be liable for any delays in delivery of orders due to a failure by the payment system to issue an authorisation.
HISPALCO delivers the products and services to Spain and to most countries of the European Union. Check with us at email@example.com. Delivery costs shall be borne by the CLIENT and shall be displayed on screen at the time of the purchase, together with the estimated delivery date.
Orders will be processed within 48 working hours of the confirmation after validating the payment method. No shipments are handled on Saturdays, Sundays or holidays (local calendar).
In the event of force majeure preventing or delaying delivery of the product and/or service, this shall be notified to the CLIENT, proposing a new product delivery date, but no liability whatsoever shall result for HISPALCO. Events of force majeure shall mean any events preventing delivery of the order for reasons beyond either party’s control, including, but not limited to, strikes, war, flood or other natural disaster, stock breakage of goods, impossibility to stock and similars.
Deliveries will be made at the address provided by the CLIENT, and in general terms within 5 working days after having processed the order, unless during the order placement a different delivery period has been offered. Please keep in mind that certain destinations may have longer delivery times, so we recommend that you check with us at firstname.lastname@example.org. No deliveries are made to Post Office boxes.
All deliveries shall be signed upon receipt. Upon being signed, the goods shall be the CLIENT’s responsibility.
In order to avoid delivery issues, it is essential to complete properly the relevant form and it is compulsory to fill in the contact telephone and e-mail boxes.
The CLIENT may cancel any product order at no cost and with no explanations, provided that the order has not been shipped. Please note that orders are dispatched on the first working day after the purchase.

The order may not be cancelled if it has already left our warehouses. However, you may return your order once it has been received, subject to the following return policy.
If the CLIENT is not satisfied after having received the product purchased, the CLIENT shall have 14 calendar days from the date of arrival of the order to use the right of withdrawal, return or change, unless the product has been unsealed after delivery, since they are sealed products are not eligible to be returned for reasons of health protection or sanitary reasons. The right of withdrawal, return or exchange will not be applicable to above mentioned products.
In this sense, the following requirements shall have to be met in order to exercise the right to withdraw, return or change the product purchased:
• The product must be in perfect condition and in its original packaging. In addition, it must not have been opened, unsealed or used.
• It must be returned in the same condition it had when it was received with the original packaging intact.
• The product may be returned by ordinary registered post to the address shown in the change process, or given when it was originally shipped.
• If you exercise your right to withdraw, you must also send us the duly completed and signed withdrawal document.
The CLIENT has the right to withdraw from this contract within 14 calendar days with no justification being required. However, the right of withdrawal is not applicable to sealed products, such as olive oil, once they have been unsealed, for reasons of health protection or hygiene. In those cases in which the product has not been unsealed, the withdrawal period will expire 14 calendar days from the day that the CLIENT or a third party indicated by him, other than the carrier, acquired the material possession of the product.
In order to exercise the right to withdrawal, the CLIENT must notify us of the decision to withdraw from the contract by means of an unequivocal declaration (for example, a letter sent by post, fax or e-mail), either sending it to HISPALCO, Calle Barranco Pascual, 45 – Pol. Ind. Campo Aníbal, 46530 Puzol (Valencia, España), to the e-mail address firstname.lastname@example.org, or by telephone +34 96 340 44 22.
You may use the standard withdrawal form you may download [here], although its use is not compulsory.
In order to meet the withdrawal deadline, it will be enough that the notice relating to the exercise of this right is sent before the relevant period ends.
If you exercise your right to withdraw, we will return all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method that is not the least expensive ordinary delivery method we offer) without any undue delay and, at all events, within not more than 14 calendar days from the date on which you advise us of your decision to withdraw from this agreement. We may withhold the refund until we have received the goods, or until you have submitted proof of return of the goods, whichever is earlier.
We shall proceed to make the refund via the same payment method you used for the initial transaction, unless you shall have expressly advised otherwise; you will at no event incur any expense as a result of the refund.
You must return or deliver the goods to us directly at HISPALCO S.A., c/ Barranco Pascual, 45 – Pol. Ind. Campo Aníbal, 46530 Puzol (Valencia, España), without any undue delay and, in any event, no later than within 14 calendar days from the date on which you notified us of your decision to withdraw from the contract. The deadline shall be deemed as met if you return the goods before that deadline has passed.
You must bear the direct cost of returning the goods.
If the purchased product presents a manufacturing or quality defect, the CLIENT may request its return, within 14 calendar days after the acquisition of the material possession of the product, providing reliable evidence of the poor condition of the product. In this case we will refund the return costs, as long as they are reasonable and we will send you another identical product without additional cost for the CLIENT, unless the CLIENT chooses to request the return of the money, in which case the entire amount paid will be paid within a period of 10 business days. The refund will be made automatically using the same means of payment used for the initial transaction.
In the event that the defect comes from a transport incident, the customer must check his package at the time of receipt and record on the delivery note of the carrier any observation in case of failure or degradation.
In order to request a product change, provided that the product has not been unsealed and is in perfect condition, the CLIENT must contact customer service, within 14 calendar days after receipt of the product. Shipping and collection costs resulting from a change shall be borne by the buyer. No freight collect shipments will be accepted under any circumstances.

HISPALCO warrants to the CLIENT that HISPALCO holds the intellectual property rights in and to the products sold and/or, as the case may be, has the necessary permission for them to be sold through its website.
The CLIENT agrees and accepts that the products, and their contents, packaging, materials, etc., are subject to Intellectual Property rights belonging to HISPALCO.
Purchase of the products and use of the website of HISPALCO shall at no event be construed as a waiver, transfer, licence or assignment, in whole or in part, to the CLIENT of the intellectual property rights belonging to HISPALCO or, as the case may be, the third party owning the same. The CLIENT may at no event alter, exploit, copy, distribute or publicly communicate the service or its contents and materials, without the prior, express consent specifically given for that purpose by HISPALCO or, as the case may be, by the relevant third party.
HISPALCO reserves the right to ammend these Terms and Conditions whenever it is deemed appropriate, or for the purpose of adapting the wording to changes in legislation or technology or its contractual relationship with third parties. The CLIENT shall be duly informed of any such changes.
If any part of these Terms and Conditions should be unlawful and therefore invalid, that shall not affect the remaining lawful provisions. The parties agree to renegotiate those parts of the Terms of business that are invalid and to include them among the remaining Terms and Conditions.
HISPALCO will not be liable for any delays or faults arising in connection with access to, functioning and operation of the website or website service, or its products, or for any downtime, suspensions or malfunctioning thereof for reasons beyond HISPALCO’s control or originating in breakdowns caused by natural disasters or events of force majeure, or extreme urgency, such as strikes, computer system attacks or intrusions (computer viruses affecting users’ devices) or any other event of force majeure or unforeseeable circumstance.
HISPALCO reserves the right to block access to its website www.hispalco.com and the provision of any or all of the website content at any time without notice, for technical, security, control or maintenance purposes, or due to any type of telecommunications network breakdown or power cuts.
HISPALCO shall not be liable for any service faults, malfunctioning or any other event beyond its direct control or due to the user’s negligence or wilful misconduct or for reasons of force majeure or credited to third parties.
HISPALCO shall have no liability whatsoever for any information, data, images of every description and links posted at its website originating in third parties and shall give no warranty either as to the truthfulness and accuracy of the information made available to users or provided by the users themselves.
HISPALCO will not be responsible for the possible damages originated in the lack of compliance with the instructions in relation to the use and maintenance of the quality of the products and / or in the lack of attention to the maximum recommended period for the treatment and / or consumption of the products supplied to the CLIENT.
Likewise, HISPALCO will not assume any liability for direct or indirect damages, consequential damages and / or lost profits.
The CLIENT shall hold HISPALCO harmless from any liability that may arise from the claims of third parties about the infringement of rights that may result from its performance.
These General Terms shall be governed by the applicable Spanish Law.
The parties hereto agree to reach a friendly settlement of any dispute arising in connection with these terms. If no such friendly settlement is possible, and where litigation is required, both parties agree, expressly waiving any other law available to them, to submit to the jurisdiction and authority of the Courts of Massamagrell (Valencia, Spain).
